Welcome to engagetracker.com (“engagetracker,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our analytics and user experience tools, dashboards, APIs, and related SaaS services (collectively, the “Services”). By using the Services, you agree to these Terms.

1) Accounts & Eligibility

  • You must be at least 18 years old and legally able to enter into these Terms.
  • When creating an account, you agree to provide accurate and complete information and keep it updated.
  • You are responsible for safeguarding your login credentials and for activity on your account.

2) Use of Services

  • You may use the Services only for lawful business or personal purposes related to analytics and user experience measurement.
  • You may not use the Services to track individuals without proper consent or in violation of data protection laws.
  • Prohibited uses include: distributing malware, scraping without permission, reverse-engineering, or reselling without authorization.

3) Subscriptions & Payments

  • Some features are available on a paid subscription basis. You agree to pay all applicable fees.
  • Billing is recurring unless canceled. All fees are non-refundable unless required by law.
  • You are responsible for any applicable taxes.

4) Data & Reports

You retain ownership of your website data, analytics events, and generated reports (“Your Data”). By using the Services, you grant us a license to process Your Data solely for providing and improving the Services.

5) Intellectual Property

The Services (including dashboards, software, design, and APIs) are owned by engagetracker or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services.

6) Availability & Changes

We strive to keep the Services reliable but do not guarantee uninterrupted uptime. Features may change or be discontinued at any time with or without notice.

7) Warranties & Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENGAGETRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 3 MONTHS BEFORE THE CLAIM.

9) Termination

You may cancel at any time. We may suspend or terminate your account if you violate these Terms or applicable law. Upon termination, your access will end and your data may be deleted per our retention policy.

10) Governing Law

These Terms are governed by the laws of Florida.

11) Changes

We may update these Terms periodically. Updates will be effective when posted. Continued use of the Services means you accept the revised Terms.
